The owner of Toledo Mack Sales & Service, which sued Mack Trucks Inc. for trying to unfairly take over its business, will get its chance to argue its anti-trust claim in U.S. District Court in Toledo.
A federal court of appeals ruled in favor of the Toledo firm yesterday, saying the firm had sufficient evidence for a jury to find that Mack dealers may have entered into an unlawful conspiracy to fix prices that hurt Toledo Mack, a franchisee.
A federal court of appeals has reinstated an Ohio dealership’s allegation that Mack Trucks violated antitrust laws by limiting competition among its dealers.
In 2006, a federal district court judge threw out Toledo Mack Sales and Service claim that Mack Trucks tried to block it from selling outside its immediate territory.
On Tuesday, a three-judge panel at the U.S. Third Circuit Court of Appeals concluded that Toledo Mack had presented enough evidence that the Sherman Anti-Trust claim should have gone to jury.
“It was a very favorable opinion,” said Wayne Mack, an attorney for Toledo Mack. “They have affirmed everything we were saying that there was evidence that Mack Trucks had conspired with dealers to limit competition.”
A court date for the anti-trust claim has not been set.
Toledo Mack, a trucking dealership since 1982, filed a complaint in 2002, claiming that Mack sold trucks and parts at lower prices directly to potential customers of Toledo Mack and other dealerships, according to court documents.
Mack admitted it might have sold trucks and parts to some franchises and customers at lower prices than it sold similar items to Toledo Mack. But it said the sales were not part of an organized program to discriminate against the dealership, and the other distributors were not direct competitors of Toledo Mack, according to court documents.

The answer, of course, is a hybrid truck that will use an electric motor to help its diesel engine - and that is just what Volvo has developed recently.
Joining forces with the US Air Force, Volvo has developed a hybrid truck technology using their I-SAM or the Integrated Starter Alternator Motor technology. The technology uses the starter alternator which doubles as an electric motor that will help a truck’s diesel engine drive the car thus increasing fuel economy as much as 35 per cent. The fuel efficiency is, of course, just like that of hybrid cars. It actually depends on the application and the driving conditions. But nonetheless, the hybrid truck has reduced fuel consumption compared to natural diesel engine-only trucks. The Volvo Group will start production of four of these hybrid-powered trucks this year for the US Air Force.
The actual mass production of the said trucks for civilian use will follow after field testing to assess their real capability under varying road and weather conditions. Scheduled for 2008 through 2009, the company aims to produce 300,000 units for the waiting market. Much anticipation can be expected from potential buyers for the release of the technology which will greatly help in the protection of the environment. Not only will these trucks have lower emissions than the natural trucks but their fuel efficiency will take lesser toll on the decreasing fossil fuel reserves available.
The technology employed by Volvo’s heavy-duty hybrid trucks, which is the use of the alternator as an electric motor, is currently employed by the Saturn Vue Green Line hybrid car. With this technology, the alternator/electric motor takes over the operation of the car during idling and other circumstances where less power is needed. This not only decreases the fuel consumption but also adds power to the truck. Volvo’s hybrid truck’s electric motor can give out a maximum of 160 horsepower and works through an electronic box, an energy storage box, and a powertrain control unit.
The truck will also have high performance parts on all its systems from steering to suspension, with high quality Volvo shocks, down to the exhaust system which will further decrease the emission from the truck’s engine. The comfort of the driver will also be given attention aside from the safety features that Volvo is known for.

Both companies are using a new process called MVASIST, which is designed to provide customers with faster, more accurate service estimates and write-ups when trucks need service. It’s an Internet application, according to Dave Albert, Mack customer satisfaction marketing manager, that simplifies the first step of the service process by providing the service writer with integrated fleet and manufacturer information.
“Our customers told us they wanted a more precise estimate of charges up front and they want the estimate to match the invoice at the end of the repair,” Albert explained. “MVASIST directly addresses these two common requests by providing dealership service personnel with an intelligent, integrated write-up process that pulls vehicle specific parts and service information so service personnel can more accurately estimate the costs and the labor needed to complete the job.”
Developed by Decisiv, Inc., MVASIST is available in two configurations for use by dealers. MVASIST/Fleet is designed for customer fleets and incorporates fleet-specific operations, inspections and contact information, while MVASIST/Pro expands on MVASIST/Fleet capabilities to provide estimating capabilities for any truck.
“In our business, knowing accurate equipment and maintenance costs is absolutely essential for making good decisions,” said John Rauschl, manager of fleet accounts for trucking company Kenan Advantage Group, a pilot customer for the MVASIST program.
“This is something our customers have asked for – the knowledge that their service estimate will be written quickly, accurately and completely, and that the final invoice matches the estimate,” added Bill Dawson, Volvo senior vp-customer satisfaction. “Using MVASIST, Volvo can take the comprehensive information we have about each truck and put it at the service writer’s fingertips in an extremely useful, integrated way.”

General Electric said that it has tested a hybrid version of a haul truck, the kind of giant Dump truck that’s used at a mine or to haul away mountains of dirt.
The system works just like a Toyota Prius, more or less. The engine feeds electricity to a battery that runs the drivetrain. During braking, the spinning wheels act as a generator for the battery.
The batteries in the hybrid off-highway truck is the same sodium-based battery used in GE’s locomotives, according to the GE Research blog.
